These Terms and Conditions (“Terms”) apply to the OrbiGuide app (“Application”) for mobile devices, created by OrbiGuide (“Service Provider”) as a free service.

By downloading or using the Application, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Application.

1. License and Intellectual Property

It is strongly advised that you thoroughly read and understand these Terms before using the Application. Unauthorized copying or modification of the Application, any part of it, or the Service Provider’s trademarks is strictly prohibited. Any attempts to extract the source code, translate, or create derivative works are not permitted.

All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider. You are granted a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial use, subject to these Terms.

2. Informational Content Disclaimer

The Application provides touristic information, points of interest, and other related content for general informational purposes only. While the Service Provider strives to keep this content accurate and up to date, no guarantees are made regarding its completeness, correctness, or reliability.

The Service Provider is not liable for any errors, omissions, or decisions made based on the content. Users should independently verify key information (e.g., opening hours, accessibility, safety) with official or local sources. Use of the content is at your own risk.

3. Modification and Service Charges

The Service Provider is dedicated to making the Application as useful and efficient as possible. They reserve the right to modify the Application or charge for its services at any time and for any reason. Any such charges will be clearly communicated.

4. Data Collection and Privacy

The Application stores and processes personal data you provide in order to deliver the service. It is your responsibility to maintain the security of your device and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your device, as this may expose your device to security risks and affect the Application’s functionality.

5. Third-Party Services

The Application uses third-party services which have their own Terms and Conditions. The Service Provider is not responsible for their content, policies, or practices. Use of these services is at your own risk.

6. Internet Connection and Data Charges

Some features require an active internet connection (Wi-Fi or mobile data). The Service Provider cannot be held responsible if the Application’s functionality is limited due to lack of connectivity or if you incur data charges from your mobile provider.

If you use the Application outside your home region or country, roaming charges may apply. By using the Application, you accept responsibility for such charges. If you are not the bill payer, you confirm you have permission from the bill payer to use the service.

7. Device Responsibility

You are responsible for ensuring your device is charged and functioning. The Service Provider cannot be held liable if your device’s battery runs out or if technical issues prevent access to the Application.

8. Warranty Disclaimer and Limitation of Liability

While the Service Provider strives to keep the Application updated and accurate, they rely on third parties for some content. To the fullest extent permitted by law, the Service Provider disclaims all warranties and shall not be liable for any damages arising from your use of the Application, including indirect or consequential damages.

9. User Conduct

You agree not to misuse the Application or use it for unlawful, harmful, or unauthorized purposes. This includes attempts to reverse engineer, disrupt, or interfere with the Application’s services or networks.

10. Updates and Termination

The Application may receive updates, which you agree to install to continue use. The Service Provider may cease providing the Application and terminate your access at any time without prior notice.

Upon termination, all rights granted to you will end, and you must stop using and delete the Application from your devices.

Changes to These Terms and Conditions

The Service Provider may update these Terms periodically. You are advised to review this page regularly. Updates will be posted here.
